PHS can increase charges at their discretion (4.2.4), there increases meant we were paying over 4 times more than a local competitor charges.
PHS can breach the contract without consequence (16.6). If customers do not pay by due date, PHS charge an extra £50 (6.1.1)
PHS can give customers 10 days’ notice to end the agreement (10.2). Customers must give 90 days’ notice and pay 75% of the remainder of the contract (12.2.2)
PHS do not issue auto renewal notices.
PHS demand 90 days’ cancellation notice prior to auto renewal.
PHS do not issue renewal contracts until after their notice period has expired. PHS made costly changes to our contract but stated as the notice period had expired, if we wanted to cancel we would have to pay 75% of the new unsigned 5 year contract, even though the contract had not started and we had not been issued the contract until after PHS’s cancellation deadline.
In PHS’s renewal contract there was a significant imbalance between their rights and ours, in favour of PHS.
