In Victoria, it is prohibited to purchase and use bird netting with an aperture size greater than 5mm x 5mm at full stretch to protect household fruiting plants. Failure to comply with this regulation could result in a fine. A 2-penalty unit infringement notice will result in a fine of approximately $363 and a court-applied penalty for a breach of these regulations can be up to 15 penalty units ($2726 approx.).
Animal Welfare Victoria describes ‘household’ fruit-trees, vegetable gardens, or other fruiting plants as:
grown at residential premises in an urban or suburban area; or
if grown at residential premises in a semi-rural or rural area, grown primarily for personal use (even if some excess produce is shared or sold).

This bird netting can be legally purchased for commercial use in the state of Victoria. Commercial use includes commercial orchards, vineyards or fruit and vegetable produce businesses. Where the objective of growing the trees or plants is to produce a commercial harvest for sale, with the intent to make a profit, the scale of such an activity should be consistent with other commercial orchards, vineyards or produce businesses.

Using Your Fruit Tree Net
This fruit tree net is cut to size for trees and bushes smaller than 1 m in height. It may also be suitable for protecting up to 3 closely planted berry bushes or grape vines at a time.
To use the fruit tree net, drape over the tree or shrub you wish to protect. Netting is more effective, will last longer and is more wildlife-friendly if secured. You can secure your netting by:
Tying the netting to the base of the tree
Weighing down the netting edges
Securing the netting to a garden frame
