You don't have to go without your refund. Did you know the Federal Trade Commission (FTC) had Fashion Nova pay a $9.3 million dollar settlement on 4/21/2020? The complaint alleges that Fashion Nova at times failed to refund consumers for the items that it did not ship. Instead, it was the company's policy to issue gift cards, which are not considered refunds under the Mail Order Rule. The company also failed to cancel orders and provide refunds when it did not offer consumers delay option notices. Under the terms of the proposed settlement, Fashion Nova will be required to pay $9.3 million to be used to refund consumers who were harmed by the company's violations of the Mail Order Rule. Of that, $7.04 million will be sent to the FTC for use in refunding consumers and $2.26 million must be refunded directly by the company to consumers. Consumers who received gift cards instead of refunds when the company violated the Mail Order Rule will be eligible for refunds under the settlement. The settlement also prohibits Fashion Nova from any further violations of the Mail Order Rule, and requires the company to ship ordered merchandise within 1-day of receipt of an order when the company doesn't specify a shipping date. With this being said I sent a LinkedIn message to Richard Saghian (Founder/CEO at Fashion Nova) and Ricky Chandnani (CFO at Fashion Nova) on 12/6/2021, told them both about my 11/29/2021 order that I never received and was coming up on my 2nd Afterpay payment, but still didn't have the merchandise. I also told them that there was no cohesive way to contact anyone directly regarding customer service issues. Someone named Adrian contacted me on 12/7/2021 from a 213-625-5900 (Los Angeles, CA no.) and tried to offer me a gift card for merchandise I have not received yet. I told Adrian all about the law suit I came across regarding violations of the "Mail Order Rule". Guess what, he went in their system and refunded my 1st Afterpay payment directly. They can refund you back your money if they want to. Also, you can file a complaint with the FTC by calling 1-877-382-4357. I still filed a complaint against them on 12/6/2021. Don't forget to write the CEO, CFO via LinkedIn, call Adrian at the "213" no. above, and file your complaint with the FTC.
